At Enqo Corp we value your privacy and the importance of safeguarding your data. This Privacy Policy (“Privacy Policy”) describes how we process your information in relation to your use of our services.

Here are some important definitions to help you understand our Privacy Policy:

  • Enqo Corp is referred to as “Enqo” “we”, “us”, and “our”.
  • Our https://enqo.com/ website is referred to as “Site”.
  • Our online software-as-service platform, that we make available through our Site, is referred to as “Platform”.
  • Our corresponding mobile application is referred to as “Mobile App”.
  • Our Site, Platform and Mobile App are collectively referred to as “Enqo Services”.
  • Users of Enqo Services are referred to as “Users”, “you” or “your”.
  • Your use of Enqo Services (including downloading, installing, registering with, accessing, or otherwise using it) is referred to as “Use”.
  • To the extent information is: (i) associated with an identified or identifiable natural person and (ii) protected as personal data under applicable data protection laws, such information is referred to as “Personal Data”.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information. By Using Enqo Services, you agree to this Privacy Policy, which is incorporated into our Terms of Service. If you do not agree to this Privacy Policy, you may not use Enqo Services.

This Privacy Policy applies to Enqo Services.

This Privacy Policy does not apply to third-party applications, websites, products, services or platforms that may be accessed through (non Enqo) links that we may provide to you. Those sites are owned and operated independently from us, and they have their own separate privacy and data collection practices. Any personal data that you provide to those websites will be governed by the third-parties’ own privacy policies. We cannot accept liability for the actions or policies of those independent sites, and we are not responsible for the content or privacy practices of such sites.

1. WHAT INFORMATION DO WE COLLECT?

We may collect several types of information, including but not limited to Personal Data, from and about you when you provide it to us directly, when you use Enqo Services, and when other sources provide it to us, as further described below.

Information You Provide to Us Directly

  • Account Creation: When you create an account on Enqo Services, we collect information such as your first and last name, email address, password, preferred language. You may also provide us and we may collect some optional information about you, such as your profile photo, location, time zone, professional tags, bio, website, LinkedIn profile.
  • Your Communications with Us: We collect Personal Data from you such as email address, phone number, or mailing address or any other identifier by which you may be contacted online or offline when you request information about Enqo Services, request customer or technical support, or otherwise communicate with us. We also collect the contents of messages or attachments that you may send to us, as well as other information you choose to provide, and that may be associated with your communications.

Information We May Collect Automatically When You Use Enqo Services

  • Your Use of Enqo Services: We may keep track of certain information about you when you visit and interact with any of Enqo Services. This information includes the features you use; the tasks, projects, teams and other links you click on; the type, size and filenames of attachments you upload to Enqo Services; frequently used search terms; and how you interact with others on Enqo Services. We also may collect information about the teams and people you work with and how you interact with them, like who you collaborate and communicate with most frequently.
  • Device and Connection Information: We may collect information about your computer, phone, tablet, or other devices you use to access Enqo Services. This device information includes your connection type and settings when you Use Enqo Services. We also may collect information through your device about your operating system, browser type, internet protocol (IP) address, MAC address and other device identifiers, logs and traffic data. We may use your IP address and/or country preference in order to approximate your location to provide you with a better service experience. How much of this information we collect depends on the type and settings of the device you use to access Enqo Services.
  • Analytics; Cookies and Other Tracking Technologies: We may also use third-party service providers to collect and process analytics and other information on Enqo Services. We and our analytics partners use cookies and other tracking technologies (e.g., web beacons, device identifiers and pixels) to provide functionality and to recognize you across Enqo Services and devices. You can change your web browser’s settings to reflect your cookie preferences. If you disable cookies, web beacons and similar technologies there might be some functionality that will not work or not operate correctly on Enqo Services.

Information We Receive from Other Sources

  • Google Sign-In Function: You may create an account on Enqo using your Google account by clicking on the “Continue with Google” button on the login page. This will request permission to use your Google account's [name, email address, language preference, and profile picture only]. This information is only stored to customize your experience and functionally run on Enqo Services. This functionality will use your Google email and password, by linking to your Google account, instead of creating your own email and password login explicitly for Enqo Services. Enqo Services does not collect or process your Google account’s password.
  • Other Services You Link to Your Account: We may receive information about you when Users enable third-party apps or integrate or link a third-party service with Enqo Services. For example, Users may also integrate Enqo Services with other services, such as to allow Users to access, store, share and edit certain content from a third-party through Enqo Services. The information we receive when you link or integrate Enqo Services with a third-party service depends on the settings, permissions and privacy policy controlled by that third-party service. You should always check the privacy settings and notices in these third-party services to understand what data may be disclosed to us or shared with Enqo Services.
  • Other Users of Enqo Services: Other Users of Enqo Services may provide information about you when they submit content through Enqo Services. For example, you may be mentioned by someone else on a task, or a team member may upload content about you to Enqo Services. We also receive your email address from other Users when they provide it in order to invite you to Enqo Services.

2. HOW DO WE USE COLLECTED INFORMATION?

We use your Personal Data to operate Enqo Services. More specifically, we collect and process your Personal Data for the purposes and on the legal bases stated below:

  • Providing Enqo Services: We process your Personal Data to perform our contract with you for the use of Enqo Services and to fulfill our obligations under our Terms of Service; where we have not entered into a contract with you, we base the processing of your Personal Data on our legitimate interest to operate and administer Enqo Services and to provide you with the content you access and request (e.g., to access our Site);
  • Promoting the security of Enqo Services: We process your Personal Data by tracking use of Enqo Services, creating aggregated, non-Personal Data, verifying accounts and activity, investigating suspicious activity and enforcing our terms and policies, to the extent this is necessary for our legitimate interest in promoting the safety and security of Enqo Services and in protecting our rights and the rights of others;
  • Managing user registrations: If you have registered for an account with us, we process your Personal Data by managing your user account for the purpose of performing our contract with you according to our Terms of Service;
  • Handling contact and user support requests: If you contact us or request user support, we process your Personal Data to perform our contract with you;
  • For billing, account management and other administrative matters: We process your Personal Data to contact you for invoicing, account management, and similar reasons and we use account data to administer accounts and keep track of billing and payments for the purpose of performing our contract with you according to our Terms of Service;
  • Developing and improving Enqo Services: We process your Personal Data to analyze trends and to track your Usage of and interactions with Enqo Services to the extent it is necessary for our legitimate interest in developing and improving Enqo Services and providing our Users with more relevant content and service offerings, or where we seek your valid consent;
  • Assessing capacity requirements: We process your Personal Data to assess the capacity requirements of Enqo Services to the extent that it is in our legitimate interest to ensure that we are meeting the necessary capacity requirements of Enqo Services offering;
  • Sending service emails and other communications: We process your Personal Data to send you service, technical and other administrative emails, messages, and other types of communications; or contact you to inform you about changes in Enqo Services and important Enqo Services-related notices, such as security and fraud notices necessary for our legitimate interest in providing you Enqo Services. These communications are considered part of Enqo Services and you may not opt out of them;
  • Sending communications about new product features and other news about Enqo: We process your Personal Data to send you emails about new product features or other news about Enqo as necessary for our legitimate interest in conducting direct marketing or to the extent you have provided your prior consent. These are marketing messages so you can control whether you receive them;
  • Complying with legal obligations: We may process your Personal Data when cooperating with public and governmental authorities, courts or regulators in accordance with our legal obligations under applicable laws to the extent the processing or disclosure of Personal Data to protect our rights is necessary for our legitimate interest in protecting against misuse or abuse of Enqo Services, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes or to respond to lawful requests; and
  • With your consent: We may process Personal Data for other purposes that are clearly disclosed to you at the time you provide Personal Data or with your consent.

Where we need to collect and process Personal Data by law, or under a contract we have entered or will enter into with you, and you fail to provide the required Personal Data when requested, we may be unable to perform our contract with you.

3. HOW DO WE SHARE AND DISCLOSE COLLECTED INFORMATION?

We do not sell your Personal Data. We do not share your Personal Data with third parties for them to market or advertise their products to you.

We may share and disclose Personal Data to the following categories of third parties:

  • Service Providers: We may share Personal Data with our third-party service providers. The categories of service providers to whom we entrust Personal Data include service providers for: (i) the provision of Enqo Services; (ii) the provision of information, products, and other services you have requested; (iii) payment and transaction processing; (iv) customer service activities; and (v) the provision of IT and related services. Additional information about third-party service providers we use to support delivery of Enqo Services is set forth at Subprocessors.
  • Corporate Affiliates: We may share Personal Data with our corporate affiliates, parents and/or subsidiaries.
  • Professional Advisers: We may share Personal Data with professional advisers, including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance and accounting services, to the extent we are legally obliged to share or have a legitimate interest in sharing Personal Data.

We may share and disclose Personal Data to other third parties, including other Users, in the following circumstances:

  • Sharing Information with Other Users: If you join a project created by another User on Enqo Services, or collaborate with other Users on Enqo Services, we may share Personal Data, such as your name, email address, profile picture and project name with the other Users.
  • Sharing Information with Your Employer: If you register an Enqo account with an email address provided by your employer, we may share information about you and any project created or managed by you on Enqo Services with your employer. Such information could include your Personal Data, such as your name, email address and profile picture.
  • During a Change to Enqo’s Business: If Enqo is engaged in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Enqo’s assets or stock, financing, public offering of securities, acquisition of all or a portion of Enqo’s business, a similar transaction or proceeding, or steps in contemplation of such activities, some or all of the collected information, including Personal Data, described in Section 1 of this Privacy Policy, may be shared or transferred, subject to standard confidentiality arrangements.
  • Law Enforcement and Regulators: If we receive a request for information, we may disclose any collected information, including Personal Data, if we reasonably believe disclosure is in accordance with or required by any applicable law, regulation or legal process.
  • To Enforce our Rights, Prevent Fraud, and for Safety: We may share any collected information, including Personal Data, to protect and defend the rights, property, or safety of Enqo, its Users, or third parties, including enforcing its contracts or policies, or in connection with investigating and preventing illegal activity, fraud, or security issues, including to prevent death or imminent bodily harm.
  • With Consent: We may share Personal Data with third parties when we have your consent to do so or as otherwise permitted in this Privacy Policy.

4. WHERE DO WE PROCESS YOUR INFORMATION?

Your Personal Data may be collected, transferred to and stored by us in the United States and by our corporate affiliates and service providers mentioned above, that are based in other countries.

Therefore, your Personal Data may be processed outside your jurisdiction, and in countries that may not provide for the same level of data protection as your jurisdiction. We ensure that the recipient of your Personal Data offers an adequate level of protection, for instance by entering into the appropriate data processing agreements and, if required, standard contractual clauses for the transfer of data as approved by the European Commission (Art. 46 General Data Protection Regulation).

We take security of your data very seriously. We work hard to protect information you provide to us from loss, misuse, and unauthorized access or disclosure. Given the nature of communications and information processing technology, we cannot guarantee that your information during transmission through the Internet or while stored on systems of our third-party service providers will be absolutely safe from intrusion by others.

5. HOW LONG DO WE RETAIN YOUR INFORMATION FOR?

We will retain your Personal Data for as long as is necessary for the purposes listed in this Privacy Policy unless a longer period is required under applicable law, or a longer period is needed to resolve disputes or protect our legal rights or otherwise comply with legal obligations.

When assessing the data retention period, we take into account the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the data, the purposes for which we process the data and whether we can achieve those purposes through other means, and the applicable legal requirements.

When we no longer need your Personal Data, we will remove it from our systems and / or take steps to anonymize it.

6. WHAT ARE YOUR RIGHTS TO YOUR PERSONAL DATA?

Regardless of what country you are located in, we respect your ability to know, access, correct, export, restrict the processing of, and delete your information, and have extended those rights globally. We will not discriminate against you for exercising your privacy rights. Your privacy rights include:

  • Right to Access: You have the right to request a copy of Personal Data we are processing about you.
  • Right to Rectification: You have the right to have incomplete or inaccurate Personal Data that we process about you rectified.
  • Right to be Forgotten (Right to Erasure): You have the right to request that we delete Personal Data that we process about you, except we are not obliged to do so if we need to retain such Personal Data in order to comply with a legal obligation or to establish, exercise or defend legal claims.
  • Right to Restriction of Processing: You have the right to restrict our processing of your Personal Data where you believe such data to be inaccurate; our processing is unlawful; or if we no longer need to process such Personal Data for a particular purpose unless we are not able to delete Personal Data due to a legal or other obligation or because you do not wish us to delete it.
  • Right to Portability: You have the right to obtain Personal Data we hold about you, in a structured, electronic format, and to transmit such data to another data controller.
  • Right to Objection: Where the legal justification for our processing of your Personal Data is our legitimate interest, you have the right to object to such processing on grounds relating to your particular situation. We will abide by your request unless we have compelling legitimate grounds for processing which override your interests and rights, or if we need to continue to process Personal Data for the establishment, exercise or defense of a legal claim.
  • Right Not to Be Discriminated: You have the right not to be denied service or have an altered experience based on having executed any of your rights above.
  • Opt-out (Withdraw Consent): If you have consented to our processing of your Personal Data, you have the right to withdraw your consent at any time, free of charge. If you wish to withdraw your consent, please contact us.

7. HOW CAN YOU EXERCISE YOUR RIGHTS?

You can make a request to exercise any of the rights stated in Section 6 of this Privacy Policy by contacting us at support@enqo.com.

We might ask you to prove your identity (for example, by requesting your user ID or some other proof of your identity) in order for you to invoke the mentioned rights. This is made to ensure that no right of third parties is violated by your request, and the mentioned rights are exercised by an actual personal data subject or an authorized person.

Please note that we will process your request within one month after receiving it. We may extend this period by two months where necessary, taking into account the complexity and number of the requests. If we extend the response period, we will let you know within one month from your request.

8. PRIVACY INFORMATION FOR CALIFORNIA RESIDENTS

If you are a California resident, you have certain rights under the California Consumer Privacy Act of 2018 (“CCPA”) and the California Privacy Rights Act of 2020 (“CPRA”; CCPA and CPRA collectively referred to as “California Consumer Privacy Laws”)), and we want to provide you with additional information about your rights.

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
    7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us. If your account is deactivated or disabled, some of your information and the content you have provided will remain in order to allow your team members or other users to make full use of Enqo Services. For example, we continue to display messages you sent to the users that received them and continue to display content you provided (including files you uploaded), but when requested details that can identify you will be removed.
    8. Comply with a legal obligation.
    9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it. If your account is deactivated or disabled, some of your information and the content you have provided will remain in order to allow your team members or other users to make full use of Enqo Services. For example, we continue to display messages you sent to the users that received them and continue to display content you provided (including files you uploaded), but when requested details that can identify you will be removed.

    Exercising Access, Data Portability, Correction and Deletion Rights

    To exercise the access, data portability, correction and deletion rights described above, please submit a verifiable consumer request to us by either:

    Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

    You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

    • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
    • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

    We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

    Making a verifiable consumer request does not require you to create an account with us.

    We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

    Response Timing and Format

    We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

    Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

    We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

    Personal Information Collection Opt Rights

    We do not and will not sell the personal information of any consumers.

    You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

  • Non-Discrimination: We will not discriminate against you for exercising any of your California Consumer Privacy Laws’ rights. Unless permitted by California Consumer Privacy Laws, we will not:

9. OUR POLICY TOWARDS CHILDREN

Enqo Services are not directed to individuals under 18 years of age. We do not knowingly collect Personal Data from children under 18. If we become aware that a child under 18 has provided us with Personal Data, we will take steps to delete such Personal Data. Enqo Services may provide links to third-party websites or resources. Enqo is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for (i) any content, advertising, products, or other materials on or available from such sites or resources, (ii) any errors or omissions in these websites or resources, or (iii) any information handling practices or other business practices of the operators of such sites or resources. You further acknowledge and agree that Enqo shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any linked sites or resources. Your interactions with such third parties will be governed by the third parties’ own terms of service and privacy policies, and any other similar terms.

11. CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. In case of material changes, we will also provide you with advance notice of the modification before the effective date. If you disagree with the revised Privacy Policy, you can cancel your account with Enqo Services. If you do not cancel your account before the date the revised Privacy Policy becomes effective, your continued Use of Enqo Services will be subject to the revised Privacy Policy.
